Terms of service

These terms cover the services Wobbl Design provides. Wobbl Design is run by Wobbl Limited, a New Zealand company. When you order a package, you're agreeing to these terms.

Prices and payment

  • Prices are shown in US dollars, New Zealand dollars or Australian dollars. If you have a written quote from us, the price on it is the one that applies.
  • The free check costs nothing. One-off builds (websites and stores) are charged when you place your order, and our refund promise below applies to them. Site-on-a-plan is billed monthly from the day you order, with a 12-month minimum that starts when you approve your preview.
  • For online stores, you pay Shopify (or your hosting), themes, apps, domains, payment fees and ad spend directly. We never resell or mark these up.
  • You can cancel a monthly plan any time before your next billing date. Site-on-a-plan has a 12-month minimum term.

Our refund promise

If your homepage preview isn't right for you, let us know within 14 days and we'll refund everything you paid for that build.

  • How it works: once we have your intake form, logo and photos, we'll send you a homepage preview within your package's delivery time. For store builds, that's your home page, a collection page and one product page.
  • If the preview isn't right for you, email us within 14 days of receiving it, before you approve it, and we'll refund everything you paid us for that build, including any add-ons ordered with it. You don't need to give a reason, and you don't have to try a round of changes first.
  • Each time we send a revised preview, the 14 days start again. If we haven't heard from you by day 15, we'll send you one email letting you know the preview will count as approved 7 days later, and on what date. If we still don't hear back, it counts as approved: the refund promise for that build ends and, for Site-on-a-plan, your 12-month minimum starts. We still won't put your site live on your domain until you tell us to.
  • We send refunds back to your original payment method, in the same currency, within 5 business days of your request, with nothing taken off for fees. Your bank may take a few more days to show it.
  • Late preview: if we haven't sent your preview within 5 business days after your package's delivery time, you're welcome to cancel for a full refund, whether or not you've seen it.
  • Once you approve the preview, we finish and launch your site or store, and the refund promise for that build ends. After that, we'll fix anything that doesn't match your package or what we agreed in writing, using your included revision rounds.
  • If you take a refund, nothing is launched. We delete the preview and everything you sent us within 30 days, and we never reuse your content.
  • Site-on-a-plan: if the preview isn't right for you, we'll refund your first monthly payment and there's nothing more to pay. The 12-month minimum only starts when you approve the preview.
  • Store builds (Shopify or WooCommerce, including the WooCommerce extra) come with the same promise. Your Shopify plan, hosting, themes, apps and domain are paid directly to those companies, so they aren't part of our refund, and we'll always tell you before you need to buy any of them.
  • Audits and set-ups: if you change your mind before we start, we'll refund you in full. Once the work is delivered, we'll fix anything that doesn't match the description.
  • Monthly plans: you can cancel any time before your next billing date and you won't be charged again. We don't refund part of a month that's already started, unless the law requires it.
  • Nothing here limits your rights under consumer law (see the Consumer law section of our terms).

Founding offer

Our first 10 clients get 3 months of the Visible plan for free, or AI Shopping Visible for store builds. There's nothing you need to do in return.

  • Who qualifies: new clients who order a Starter, Standard or Plus build, or start Site-on-a-plan. Store builds (Shopify or WooCommerce) get AI Shopping Visible free for 3 months instead.
  • When it starts: the 3 free months start on your launch day.
  • The 10 places are shared between website and store builds: 10 in total, not 10 of each.
  • After 3 months it simply ends, unless you'd like to keep it at US$60/mo (NZ$105, A$85) for Visible or US$70/mo (NZ$125, A$100) for AI Shopping Visible. You won't need a card for the free months.
  • How the first 10 are counted: in the order builds are paid for (or the first Site-on-a-plan month is). If a build is refunded, its place goes to the next client.
  • End date: the offer closes once 10 clients have joined, or on 31 March 2027, whichever comes first.
  • We don't ask for anything in return, like a review, testimonial or referral.

Your content and ownership

You own your domain, your content and your business listings. By sending us words, photos or logos, you're confirming you have the right to use them. If you leave, we'll hand over your content.

Revisions and scope

Each package includes the revision rounds, page counts and product counts listed on the pricing page. If you'd like extra work, we'll quote it before we start.

Online stores

Store policies we draft (such as shipping, returns, privacy and terms for your shop) are templates for you to review. You're responsible for them and for what your store sells and says. On Shopify, you give us collaborator or staff access. On WooCommerce, you give us a WordPress user account you can remove any time. You can remove our access at any time, and we'll never ask for your password.

Consumer law

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (NZ), or the Australian Consumer Law, where they apply. If you are buying for business purposes, the parties agree the Consumer Guarantees Act does not apply to the extent permitted by law.

AI claims policy

No one can control what AI assistants say, and their answers change from day to day. What we can do, on the Visible plan, is check your details every week, fix anything wrong on your site, send you the changes to make anywhere else and show you what was said each month.

  • We never guarantee Google rankings or that any AI assistant will name or recommend your business.
  • AI visibility results are saved word for word with the date, model and question, so you can see exactly what was said.
  • Any stats we publish come from real data with a source and date. Concept designs on our site are labelled "Example".

Liability

To the extent allowed by law, our total liability is limited to the fees you paid in the 3 months before the claim.
